Article 1Applicability and definitions

  1. We: Luxury for Princess B.V., also trading as The Luxury Hair Salon, Rennemigstraat 19, 6413 BR Heerlen, Chamber of Commerce number 89767632, VAT NL865100032B01. Customer (also: you): the natural or legal person who purchases from us or attends a training course in the course of a profession or business.
  2. These business terms apply to every offer, order, and agreement between us and the customer. Our general terms and conditions also apply. In the event of a conflict, these business terms take precedence.
  3. These terms are available on our website before you apply for an account or place an order, and you can download and save them as a PDF. By applying for a business account or placing an order while logged in, you accept these terms.
  4. Provisions that apply only to consumers, such as the right of withdrawal, the 30-day cooling-off period, and the additional manufacturer's warranty for consumers, do not apply to the customer.
  5. The customer's purchase or other terms and conditions do not apply unless we have accepted them in writing.
  6. Deviating agreements apply only if we have confirmed them in writing (including by email), and only to the agreement for which they were made.

Article 2Business account

  1. You can apply for a business account using the application form, providing your company name, contact details, Chamber of Commerce number (or registration in your country's commercial register), and VAT number.
  2. By applying, you declare that you use the account for your profession or business and not as a consumer. Orders placed through the account are considered business purchases.
  3. We review every application and may reject an application without giving a reason. You can place orders under business terms only after we confirm your application.
  4. The customer is responsible for the accuracy of the information provided and must notify us immediately of any changes (such as a new address, VAT number, or the closure of the business).
  5. We may suspend or close an account if the customer fails to comply with these terms, fails to pay (on time), has provided incorrect information, or is no longer operating a business. Any outstanding amounts will then become immediately due and payable.

Article 3Logging in and use

  1. After approval, you can log in to the business area of our webshop. There you can see your purchase prices and volume discounts, and order professional products that consumers cannot buy.
  2. The account is linked to your business. Keep your login details confidential and do not share them with third parties. Orders placed through your account are considered orders placed by the customer.
  3. If you suspect misuse of your account, let us know immediately at info@luxuryforprincess.com.
  4. We do our best to keep the webshop accessible, but cannot guarantee that it will always operate without disruption.

Article 4Prices, tiered pricing and VAT

  1. Business prices are the prices you see in the webshop after logging in. They include VAT and exclude shipping costs, unless stated otherwise.
  2. A tiered price applies per item, based on the quantity you purchase in a single order.
  3. Discount codes and promotions for consumers do not apply on top of business prices, unless we expressly state otherwise.
  4. If you are based in another EU country and have a valid VAT number, please contact us before placing your first order. We will then check whether the VAT can be reverse-charged.
  5. We may change prices and tiered pricing. The price at the time you place your order applies.
  6. Obvious errors or mistakes in prices, images or product information are not binding on us.
  7. Suggested retail prices for sales to your customers are recommendations only. You set your own selling prices.

Article 5Ordering

  1. You place an order through the webshop while logged in. The agreement is concluded as soon as we confirm your order by email.
  2. We may refuse an order or deliver it in parts, for example if a product is out of stock. If a product is unavailable, we will let you know as soon as possible and refund the amount paid for that product.
  3. You may change or cancel an order only as long as it has not yet been processed. Please contact us as soon as possible.

Article 6Payment

  1. You pay at checkout using one of the payment methods available in the webshop.
  2. Payment on account is available only if we have enabled it for your account. The payment term is then 14 days from the invoice date.
  3. If you do not pay on time, you will be in default without notice of default. You will then owe the statutory commercial interest (Article 6:119a of the Dutch Civil Code) and the costs of collecting the amount. Extrajudicial collection costs are 15% of the outstanding amount, with a minimum of € 40.
  4. You may not offset a payment against an amount that we (according to you) owe you, or suspend payment.
  5. As long as any amount due remains unpaid, we may postpone new deliveries or make them only against advance payment.

Article 7Delivery and risk

  1. We ship with UPS, in accordance with our shipping policy. You’ll see the shipping costs at checkout.
  2. Delivery times are estimates and are not strict deadlines. Late delivery does not entitle you to compensation or cancellation, unless the delay is so significant that you can no longer reasonably be expected to proceed with the order.
  3. The risk of loss or damage passes to you when the goods are delivered to the specified address. Delivery to a neighbor or a UPS Access Point also counts as delivery. If a shipment goes missing before delivery, we will investigate the matter with UPS and arrange a solution.
  4. Shipments outside the EU: import duties, customs fees and local taxes are the responsibility of the customer.

Article 8Retention of title

  1. Delivered products remain our property until all amounts you owe for those products and previous deliveries have been paid in full.
  2. Until then, you may process or resell the products only in the ordinary course of your business, and may not pledge them or otherwise encumber them.
  3. If you do not pay on time, we may retrieve products that are still our property. You must give us access to the place where they are located.

Article 9Inspections and complaints

  1. Check every delivery immediately upon receipt for quantities, damage, and whether you received the correct products, colors, lengths and weights.
  2. Report visible discrepancies within 7 days of receipt via info@luxuryforprincess.com, including your order number and photos. Report other defects within 7 days of discovering them or when you could reasonably have discovered them.
  3. Check the color and quality before processing, for example by using the test strand. Once extensions have been cut, dyed, bleached, displayed or fitted, you can no longer claim a discrepancy that you could have noticed beforehand.
  4. Real hair is a natural product. Color and texture may vary slightly between batches, and colors shown on a screen or in a photo may differ from reality. Such minor differences are not defects.
  5. A complaint does not suspend your payment obligation.
  6. If a complaint is justified, we decide whether to replace or repair the product, or issue a credit for the purchase price.

Article 10Returns

  1. Consumers do not have a right of withdrawal or cooling-off period for business purchases. This means you cannot simply return an order that was delivered correctly.
  2. Returns are only possible with our written approval. Do not send a package back without contacting us first.
  3. For hygiene reasons, we only accept returns of hair extensions if the seal is intact, the extensions have not been removed from the packaging, and the test strand is returned undamaged. We do not accept returns of opened hair care products, including salon-size packages.
  4. For an approved return, you are responsible for the shipping costs unless we made a mistake. Once we have received and inspected the items, you will receive a credit note.

Article 11Warranty and application

  1. We warrant that, upon delivery, the products comply with their product description and meet the quality you may reasonably expect.
  2. You are responsible for applying, cutting, coloring and maintaining extensions for your customers, and must do so in accordance with applicable professional standards. This includes conducting a proper consultation, advising on care and, where necessary, performing a sensitivity test.
  3. The warranty does not cover damage caused by improper processing or application, chemical treatment (such as dyeing, toning or bleaching), heat above 120 °C, improper care or normal wear and tear.
  4. You are the point of contact for your own customers. Any arrangements you make with your customers about warranties or results do not bind us.

Article 12Resale and use of the brand

  1. You may use the products in your own business and resell them in their original packaging.
  2. The name and logo of Luxury For Princess, our product photos, videos and texts belong to us. You may use them only to offer our products and only in a way that does not harm the brand. We may require you to modify or stop that use at any time.
  3. You may not describe yourself as an official partner, dealer or branch of Luxury For Princess without our written permission. With a valid certificate, you may state that you have been trained in the relevant method.
  4. You may not sell the products under another brand name or change any packaging or labels.

Article 13Liability

  1. Our liability is limited to the invoice value (including VAT) of the order associated with the damage.
  2. We are not liable for indirect damage, such as consequential loss, loss of profit, loss of revenue, reputational damage or damage caused by business interruption.
  3. We are not liable for damage arising from the way you process, apply or recommend the products. You indemnify us against claims by your customers or other third parties in connection with this.
  4. The limitations in this article do not apply in cases of intent or conscious recklessness on our part or that of our managers, nor where the law does not permit them.
  5. Any claim against us expires if you have not submitted it to us in writing within one year after you knew or should have known about the damage.

Article 14Force majeure

  1. In the event of force majeure, we may suspend our obligations. Force majeure also includes a failure by suppliers or carriers, transport or customs problems, illness, and disruptions to the webshop or payment systems.
  2. If the force majeure lasts longer than 60 days, either party may terminate the agreement for the part not yet delivered, without compensation.

Article 15Training courses and certificate

  1. You can register for a training course through our website or by email. Your registration is final once we confirm it by email. The price and dates are stated in that confirmation.
  2. You must pay for the training before the first training day. You cannot participate without payment.
  3. Cancellations must be made by email. You can cancel free of charge up to 14 days before the first training day. After that, you will pay 50% of the price, and from 7 days before the training or in the event of non-attendance, the full price. You may send someone else in your place free of charge, provided you notify us in advance.
  4. If you cannot attend a training day, we will work with you to find another date, subject to availability. Additional charges may apply.
  5. We may reschedule or cancel a training course, for example, if there are too few participants or the trainer is ill. You can then choose another date or receive a refund of the amount paid. We do not reimburse any additional costs, such as travel or accommodation expenses.
  6. You will receive the certificate after successfully completing the entire training course. The certificate is personal and applies only to the method in which you were trained.
  7. Training materials are for your personal use only. You may not copy, share or use them to train others.
  8. If you take a training course as a consumer, rather than for your profession or business, these business terms do not apply. You will then have the rights granted to consumers by law, and our general terms and conditions will apply.

Article 16Privacy and confidentiality

  1. We process the customer’s and its contact persons’ data in accordance with our privacy policy. We use external service providers for our online store, business portal, payments and shipping.
  2. Business prices, volume discounts and other agreements are confidential. Do not share them with consumers or other third parties.

Article 17Amendments

  1. We may amend these terms. The new version will be posted on our website, together with its effective date, and will apply to orders placed from that date onward. We will send you an earlier version upon request.
  2. We will notify you by email in advance of any significant changes.
  3. If a provision is void or is annulled, the remaining provisions will remain in effect. We will then replace that provision with a valid provision that most closely reflects the original intent.

Article 18Governing law and disputes

  1. All agreements with the customer are governed by Dutch law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
  2. We will first try to resolve disputes between ourselves. If we cannot, only the Limburg District Court has jurisdiction.
  3. These terms have been drafted in Dutch. In the event of any discrepancy between a translation and the Dutch text, the Dutch text shall prevail.
